Tax Charges
Sales to addresses within the UK/EU are subject to UK Value added Tax (VAT) at 20%. Children's clothing is zero-rated for VAT. Sales to outside the UK/EU are exempt from UK taxes.
Relief of tax is available for "disabled people" (please see below). However, we must receive a Declaration of Eligibility at the time of your order, otherwise we will have to charge VAT. This applies in particular to both allergy bedding products and adult sizes of silver clothing - but why would you buy it these if you don't have a problem which would qualify you for relief?
VAT DECLARATION
In order to NOT pay VAT, you need to make the following declaration: "I declare that I am chronically sick and disabled by reason of asthma, eczema and/or dust allergy, and that the goods are being supplied to me for my own (or someone in my care) domestic or personal use, and I claim relief from VAT under group 12 of schedule 8 to the VAT act 1994". This is a declaration made by you, the customer, and does not need confirmation by a doctor or health professional. When ordering you will be asked to tick a box to claim relief. You must then enter your name to make this declaration.
HM CUSTOMS AND EXCISE VAT REGULATIONS
Supplies can be zero-rated for VAT so long as all three of the following conditions are met: 1. The customer is eligible. 2. The goods are for the personal or domestic use of the customer. 3. The goods are eligible to be supplied at the zero-rate.
Eligible Persons
Supplies to "handicapped people" - If he/she is "chronically sick or disabled". This means having a physical or mental impairment which has a long-term and substatial effect on his/her ability to carry out everyday activities; or, having a condition which the medical profession treats as a chronic sickness. Our VAT inspector confirms that persons with asthma, eczema and/or chronic dust mite allergies meet these criteria. Hay Fever does not.
If a parent, spouse or guardian acts on behalf of a "chronically sick or disabled" person, the supplies can be treated as being made to that "chronically sick or disabled" person.
Eligible Goods
These include medical and surgical appliances. Specialised allergen barrier bedding and silver coated products for eczema treatment are classifiable as such - We are registered with the Medical Devices Agency as manufacturers of "Medical Devices".
Personal or Domestic Use
This means they are for you and/or your familly and not for commercial purposes or resale.
WARNING
There are penalties for making a false declaration. If you have enquiries about your status you may wish to consult VAT Notice 701/7, available at www.hmce.gov.uk , or you can contact the Customs and Excise National Advice Line on 0845 010 9000 |

The ladies who work in our Halifax factory boast to their friends that they don't sew clothes or bedding, but make "Medical Devices". The pride they take in their work and their attention to detail explains why the only defective products we have returned to us represent less than 0.001% of output and each one of those was due to a problem with the zip, which we have to buy in. |
